1. Definitions

• Platform – The Dogomania website (dogomania.com, dogomania.pl), mobile applications, and all related services.
• User – Any person who accesses or uses the Platform, whether registered or not.
• Breeder – A registered user who creates and manages a breeder/kennel profile on the Platform.
• User Content – Any text, images, data, or other material uploaded, posted, or transmitted by users on the Platform.
• Service – All features and functionalities provided through the Platform, including the breed database, breeder directory, puppy reservations, articles, and forum.

2. Acceptance of Terms

By accessing or using the Dogomania Platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you must not use the Platform. We reserve the right to modify these terms at any time, and your continued use of the Platform constitutes acceptance of the modified terms.

3. User Accounts

• You must be at least 16 years old to create an account.
• You must provide accurate and complete information when registering.
• You are responsible for maintaining the security of your account credentials.
• Each person may maintain only one account. Duplicate accounts may be terminated.
• You are responsible for all activities that occur under your account.

4. Acceptable Use

When using the Platform, you agree not to:

• Violate any applicable laws or regulations.
• Post content that is abusive, threatening, defamatory, obscene, or otherwise objectionable.
• Send unsolicited messages, spam, or commercial advertisements.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation.
• Use automated systems (bots, scrapers) to access the Platform without prior written consent.
• Upload or transmit viruses, malware, or other harmful code.

5. User Content

You retain ownership of content you create and upload to the Platform. However, by posting content, you grant Dogomania a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with the Platform.

This license exists solely for the purpose of operating, developing, and improving the Platform. You may request removal of your content at any time, subject to reasonable processing time.

You are solely responsible for the content you post. Dogomania reserves the right to remove any content that violates these Terms without prior notice.

6. Breeder Responsibilities

Breeders who create profiles on the Platform agree to additional obligations:

• Provide accurate and up-to-date information about their kennel, dogs, and litters.
• Adhere to animal welfare standards and ethical breeding practices.
• Comply with all applicable local, national, and international laws regarding animal breeding and sales.
• Honor reservations and deposits made through the Platform in good faith.
• Respond to inquiries from potential buyers in a timely and professional manner.

7. Reservations and Payments

The Platform facilitates puppy reservations between breeders and buyers. Dogomania acts solely as an intermediary and is not a party to any transaction between breeders and buyers.

Dogomania is not responsible for the quality, health, pedigree, or any other aspect of dogs sold through the Platform. Disputes between breeders and buyers should be resolved directly between the parties.

8. Intellectual Property

The Dogomania name, logo, design, and all platform content created by us (excluding user content) are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of our proprietary content without explicit written permission.

9. Limitation of Liability

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, Dogomania shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or other intangible losses.

10. Account Termination

We may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. Upon termination, your right to use the Platform ceases immediately. You may request deletion of your account and personal data in accordance with our Privacy Policy.

11. Changes to Terms

We reserve the right to update these Terms of Service at any time. Material changes will be communicated through the Platform or via email. Your continued use of the Platform after such changes constitutes acceptance of the updated terms. If you disagree with the changes, you should stop using the Platform and request account deletion.

12. Governing Law

These Terms are governed by the laws of the Republic of Poland. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts in Poland. For consumers resident in the EU, this does not affect your rights under mandatory consumer protection laws of your country of residence.
